In her application filed at the Milimani Law Courts, she called on the court to order Lee Funeral Home not to release the politician's body to his relatives.
Speaking at her lawyer Danstan Omari's office in Nairobi, Milka said she and Chepkut wedded in the church in 1998. They lived together and had two sons until 2010, when he stopped coming home.

Milka said she later realised the former MP had had an affair where he sired four children with two other women during their marriage.
In 2020, she said the MP developed a knee problem and his siblings brought him another wife to take care of him while in the hospital. When he was discharged, he went to live with the woman.
Milka lamented that the MP's relatives had excluded her from the burial arrangements, questioning who would comfort her and the children.
She claimed that she and her son were arrested and locked up on Friday, October 14, during his requiem mass for being a nuisance.
She said she is worried about the future of her two sons because most of her family property are in the hands of the politician's relatives.
The publication reported that after 10 years in the cold, ANC party leader Musalia Mudavadi is set to get back into the government as the Prime Cabinet Secretary, but only if the National Assembly confirms his nomination.

Mudavadi will be the first one off the blocks in the vetting exercise on day one. The others in the queue on the first day are former National Assembly Speaker Justin Muturi (Attorney-General), MP Aden Duale (Defence), Alice Wahome (Water) and ex-governor Alfred Mutua (Foreign Affairs).
The vetting of Mudavadi comes as Speaker Moses Wetang'ula is expected to rule on the constitutionality of the position he was nominated for after being petitioned by MP Opiyo Wandayi.
The daily reported that the disbanded three-year Special Service Unit (SSU) is in the eye of a storm following reports that its officers could have been behind the abduction and disappearance of two IT specialists.
Speaking in Kericho on Sunday, October 16, Ruto said he had personally ordered the disbandment of the elite unit, accusing it of being responsible for a spate of extra-judicial killings in the country.
