Mary Ciambaka from Kathigiri in Chuka town, Tharaka Nithi county, is expected at the Environment and Lands Court on January 31, 2023, to face none other than her own son.
What worries the sickly 84-year-old granny is not even the fact that her scion Alex Kinyua has risen against her, but that she cannot afford an advocate.

While addressing members of the press, the octogenarian indicated that she was hoping the government would provide her with a pro-bono lawyer, Daily Nation reports.

She disclosed that most of the property she owned, including all the trees on the land she has lived for 18 years was sold off earlier to raise legal fees when the case was tabled at the magistrate’s court.
In the earlier ruling, Mary won the case and Alex was directed to keep off the land but he appealed and the lack of an advocate is making her worried he will win this time.

Mary added that when the court ruled in her favor, thought her son, a retired police officer, would accept the verdict and move on but he filed an appeal.
Her financial struggles stem from the fact that she is suffering from hypertension and diabetes, which makes it impossible for her to work and raise money for legal services.
In Kenya, it is possible for the government to provide an advocate under the pauper briefs and pro bono services act once it is established that the applicant is extremely poor.
As a matter of fact, it is a constitutional right for every Kenyan to be accorded a lawyer for justice if they are unable to afford a private lawyer.
